GENERAL TERMS AND CONDITIONS (GTC) FOR THE RENTAL OF HOLIDAY HOMES

1. Conclusion of Contract, Deposit and Right of Withdrawal
a) The rental contract for a holiday property is concluded through the tenant’s booking (offer)—whether made in person, by telephone, fax, email, via our website, etc.—and the landlord’s dispatch of the booking confirmation (acceptance).
b) Upon receipt of the booking confirmation, the due dates for the deposit and the remaining payment of the agreed rental price are determined. The deposit is generally due 14 days after conclusion of the contract. The tenant must transfer 20% of the rental price as a deposit within 14 days of receiving the invoice to the following account:

The remaining balance must be paid no later than two weeks prior to the start of the rental period to the same account. If payment is not made on time, the landlord reserves the right to withdraw from the rental contract. If fewer than 14 days lie between the conclusion of the contract and the start of the rental period, the full amount must be paid immediately upon conclusion of the contract.
2. Travel Cancellation Insurance
We kindly recommend taking out suitable travel cancellation and interruption insurance including coverage for inventory items. For example, ERGO travel insurance provides such information.
3. Minimum Rental Period
The minimum stay is three nights; during peak season and on public holidays, it is between five and six nights. Deviations may be technically requested via the booking platform, but the landlord is not obligated to accept such requests.
4. Tenant Liability
The tenant is provided with a clean and properly maintained holiday property with complete inventory. Any damages, uncleanliness, or missing items must be reported to the landlord immediately upon arrival. Reasonable repair times must be accepted. The tenant must handle the property and its inventory with care and protect it from damage. Any damage occurring during the rental period must be reported immediately and is the tenant’s responsibility. We recommend insurance that includes inventory coverage.
5. Liability of the Owner / Landlord
The landlord is liable for damages only if they result from the breach of an essential contractual obligation or from intentional or grossly negligent conduct by the landlord, their legal representatives, or agents. In the event of slightly negligent breach of an essential contractual obligation, liability is limited to foreseeable, typical damages. Essential contractual obligations are those whose fulfillment enables proper performance of the contract and on which the tenant may rely. Any further liability for damages is excluded. Liability for culpable injury to life, body, or health remains unaffected. The landlord’s strict liability for initial defects pursuant to § 536a(1) Alternative 1 BGB is excluded unless such defects concern injury to life, body, or health.
6. Guest Card
The landlord is required to register every guest with the local tourism service and collect the tourist tax as stipulated by the current statutes of the Kurverwaltung Sylt-Ost Tinnum. If the tenant submits the completed guest registration form in time, the guest cards will be available in the property upon arrival.
7. Pets, High Chair, Rental Linen, Internet Use, Electronic Devices
a) Pets are only permitted with prior agreement and approval from the landlord. Leashes are required on the property, and pets must not be left alone in the apartment. Pets may not relieve themselves in the garden, and are not allowed on beds or sofas.
b) A high chair and children’s tableware are available in the upstairs apartment if available.
c) If rental linen packages are booked, the property will be provided with linen (bed linen, kitchen towels, table linen, and bathroom towels).
d) The apartment is equipped with Internet/Wi-Fi. The landlord accepts no liability for the functionality of the Internet/Wi-Fi or any resulting damages, particularly in cases of power outages or malware. Any misuse of the Internet/Wi-Fi—including accessing illegal content or infringing copyright—is prohibited. The tenant shall indemnify the landlord from any third-party claims arising from misuse.
e) Due to renovations or changes by the owner, the actual furnishings may differ from those shown on the website.
f) There is no guarantee for the functionality of electronic devices in the property. Due to the island location, immediate replacement cannot be guaranteed in case of malfunction, although efforts will be made to resolve issues promptly.
8. Occupancy Limit
The landlord defines a maximum number of occupants for each property. This limit may not be exceeded without written approval. Subletting or otherwise transferring the property to third parties, whether for payment or free of charge, is prohibited. In the event of a violation, the landlord may terminate the rental contract without notice.
9. Arrival and Departure, Key Handover, Parking
a) On the day of arrival, the property is available from approx. 16:00. On the day of departure, it must be vacated by 10:00 at the latest, and the keys must be left in the apartment. In case of delayed departure or key return, the landlord reserves the right to charge additional daily rent and claim damages. The property must be left:

dishes washed

refrigerator emptied

all windows and doors closed
Failure to do so may result in additional cleaning charges.
b) Keys will be deposited in a key safe at the property once full payment has been received. The tenant will receive the access code prior to arrival. In case of key loss, the tenant is liable for the resulting costs (minimum €50).
c) Parking space 13c belongs to the apartments and is available for both units. Additional free parking is available along the street. Use of parking space 13c is at the tenant’s own risk. Parking on spaces 13a and 13b is not permitted.
10. Cancellation of the Contract
a) If the property is destroyed or rendered uninhabitable due to fire, storm, water damage, or similar events, the landlord may offer a comparable replacement property from another provider or withdraw from the contract without the tenant having any claim for reimbursement of travel expenses such as flights or train tickets.
b) If the tenant cancels the contract before the rental period without naming a replacement tenant who enters under the same conditions, the tenant remains liable for payment of the rent. The landlord must deduct saved expenses (typically 20% of the rent) and income from re-letting. The tenant may therefore be required to pay 80% of the rent even if the property is not used. We strongly recommend travel cancellation insurance.
In the event of cancellation, the following fees apply (percentage of rental price):

11. Data Protection Information
This privacy notice informs you of the type, scope, and purpose of the processing of personal data within our online offering and associated websites, functions, and content, as well as external online presences (“Online Offering”). For definitions such as “processing” or “controller,” we refer to Article 4 of the GDPR.

12. Miscellaneous
Side agreements, amendments, or additions to the rental contract, including these terms, should be made in writing for evidentiary purposes. Should any provision of this contract be or become invalid, the remaining provisions shall remain in effect. The invalid provision shall be replaced by the statutory regulation.
These General Terms and Conditions (GTC) form part of the rental agreement.
